Section 15 — Product Safety and Rider Responsibility
Electric bicycles are motorized vehicles subject to local, state, and federal regulations. By purchasing and using a TXED eBike, you agree to:
· Comply with all applicable federal, state, and local laws governing the operation of electric bicycles in your jurisdiction
· Understand the eBike classification (Class 1, 2, or 3) applicable to your model and observe all speed and usage restrictions
· Wear an appropriate helmet and protective gear when riding
· Perform regular safety inspections before each ride
· Not modify the motor, battery, or controller in any way that alters the bike's classification or safety
· Not allow anyone under the age of 18 to operate the eBike without appropriate adult supervision
TXED eBikes is not liable for injuries, accidents, or legal violations resulting from improper use, failure to comply with local laws, or unauthorized modifications to the product.
Section 16 — Intellectual Property
All content on this website — including text, images, graphics, logos, product photos, and code — is the property of TXED eBikes and protected under U.S. and international copyright and trademark law. Unauthorized reproduction or use is prohibited.
Section 17 — Force Majeure
TXED eBikes shall not be held liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to: acts of God, natural disasters, pandemics, government restrictions, supply chain disruptions, carrier delays, labor strikes, or acts of war or terrorism.
Section 18 — Dispute Resolution and Arbitration
Informal Resolution First
Before initiating any formal legal action, you agree to contact us at service@txedbikes.com and attempt to resolve the dispute informally. We will try to resolve most concerns within 30 days.
Binding Arbitration
If informal resolution fails, any dispute arising out of or relating to these Terms shall be settled by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court.
Class Action Waiver
You agree that any arbitration or proceeding shall be limited to the dispute between TXED eBikes and you individually. To the fullest extent permitted by law, you waive the right to participate in a class action lawsuit or class-wide arbitration.
Exceptions
Either party may seek emergency injunctive or equitable relief in a court of competent jurisdiction to prevent irreparable harm.
Section 19 — Governing Law
These Terms of Service and any disputes arising hereunder shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict of law principles.
Any legal action not subject to arbitration shall be brought exclusively in the state or federal courts located in Los Angeles County, California. You hereby consent to the personal jurisdiction of such courts.
Section 20 — Severability
If any provision of these Terms is determined to be unlawful, void, or unenforceable, such provision shall be deemed severed and the validity of all remaining provisions shall not be affected.

These Terms of Service, together with our Privacy Policy, Cookie Policy, Refund Policy, and Shipping Policy, constitute the entire agreement between you and TXED eBikes regarding your use of this website.
